Judge orders retrial in van driver crash death case

A man accused of causing the death of a road worker by dangerous driving is to face a retrial.

Earlier this week Exeter Crown Court heard that Anthony Tompkins was “on eBay” around the time he veered into highway workers and killed an operative.

The court was told that Tompkins was driving at 55mph on the A361 in North Devon when the incident happened.

Steven Tolly, 48, was hit by the wing mirror of the van inside protective cones and suffered head injuries. He died six days later in Derriford Hospital, Plymouth.

Tompkins, of Trehurst Farm, Saltash, Cornwall, denies causing death by dangerous driving.

Yesterday (7 January 2015) Judge Erik Salomonsen discharged the jury and ordered a retrial.
